Terms of Service

Please read these Terms of Service (“Terms”) carefully before using localinvitation.com and related services (the “Service”) operated by LocalInvitation.com (“we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission. By using the Service you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@localinvitation.com of any unauthorised use of your account. We are not liable for losses arising from unauthorised use of your account.

3. Use of the Service

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Post events or content that is fraudulent, misleading, defamatory, obscene, or infringes any third-party intellectual property rights.
  • Use the Service to sell tickets to events that do not exist or that you do not have authority to organise.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Scrape, crawl, or extract data from the Service without our prior written consent.
  • Use the Service to send unsolicited commercial communications (spam) to attendees.

4. Organiser Responsibilities

If you create events and collect payments through the Service, you (“Organiser”) agree to:

  • Deliver the event as described. If an event is cancelled or significantly changed, you are responsible for communicating with attendees and issuing refunds as required by applicable law.
  • Comply with all applicable laws, including consumer protection, tax, and local event permitting requirements.
  • Provide accurate event details including date, time, location, ticket pricing, and any age or dress-code restrictions.
  • Ensure you have the legal right to host the event and collect payment from attendees.

5. Payments and Fees

Payment processing for ticket sales is provided by Stripe. By accepting payments through the Service you agree to Stripe's Connected Account Agreement. We may charge a platform service fee on ticket sales; any applicable fees will be disclosed at the time of account setup or within the platform settings.

Payouts are subject to Stripe's payout schedule and your account verification status. We are not liable for delays caused by Stripe or your financial institution.

6. Refunds and Cancellations

Our platform supports organiser-managed refunds. Refund policies for specific events are set by the Organiser. We are not responsible for an Organiser's failure to issue refunds. In cases of event fraud we reserve the right to issue refunds on behalf of the Organiser and recover those funds from their Stripe account.

7. Intellectual Property

The Service and its original content (excluding user-submitted content) are the exclusive property of LocalInvitation.com and are protected by copyright and other intellectual property laws.

By submitting content (event descriptions, images, etc.) to the Service, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Service.

8. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Facebook/Instagram (social posting), and Google (OAuth login). Your use of those integrations is governed by the respective third-party terms of service. We are not responsible for the conduct or availability of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCALINVITATION.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) CAD $100.

11. Indemnification

You agree to indemnify and hold harmless LocalInvitation.com, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users or the Service. You may delete your account at any time from your account settings.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of British Columbia.

14. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes via email or a prominent notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
